Privacy notice

This is an English translation provided for convenience. The Spanish version, Aviso de privacidad, is the governing version under Mexican law.

1. Who is responsible for your data

Víctor López Valerio, a physician specialized in Orthopedics and Traumatology (the "Data Controller"), with an address for notices at Av. Ignacio Morones Prieto 3000, Piso 7, Consultorio 9, Centro Médico Hospital San José, Monterrey, N.L. 64718, Mexico, is responsible for processing your personal data under Mexico's Federal Law on the Protection of Personal Data Held by Private Parties.

2. What data we process

• Identification and contact: name, phone, WhatsApp number, email, age and city of residence.
• Health data (sensitive personal data): symptoms, medical history, imaging (MRI, X-rays), diagnoses, treatments, results of tools such as the knee test, and your medical record.
• Administrative data: insurance company, policy number and billing details, when you provide them.
• Browsing data: technical information collected by the measurement tools on this site (see section 8).

Health data is handled with reinforced security measures. By voluntarily sending us health information (for example, your imaging or symptoms over WhatsApp) and by signing this notice at your appointment, you give your express consent to its processing for the purposes described here.

3. Why we use your data

Necessary purposes:

• Answering your messages and scheduling appointments, including video consultations.
• Providing medical care: diagnosis, treatment, surgery, rehabilitation and follow-up.
• Keeping your medical record as required by health regulations.
• Preparing quotes and coordinating with the hospital, laboratories and, at your request, your insurer.
• Invoicing and complying with legal obligations.

Additional purposes, not necessary to treat you:

• Measuring how the website and online advertising perform.
• Asking for your feedback or a review of the care you received.
• Sending you information about knee health and the clinic's services.

If you do not want your data used for additional purposes, tell us through the channels in section 6. It will not affect your care.

4. Who we share your data with

• The hospitals where you are treated (Centro Médico Hospital San José and Christus Muguerza San Pedro), and the laboratories, imaging centers and physicians involved in your care, such as anesthesiologists.
• Health or judicial authorities, when required by law.

With your consent, we may also share it with your insurer for reimbursement or direct payment. We do not sell your personal data.

5. How long we keep it

Medical records are kept for the period required by applicable health regulations. Other data is kept only as long as needed for the purposes above and is then deleted or anonymized.

6. Your rights

You have the right to access, rectify and cancel your data and to object to certain uses (ARCO rights). You may also revoke your consent and ask us to limit the use or disclosure of your data. Send your request:

Include your name and a way to reply, a copy of your official ID (or proof of representation), a clear description of the data and the right you want to exercise, and any document that helps locate your data. We will respond within the deadlines set by law. Some data, such as your medical record, must be kept by law even if you request its cancellation.

7. Limiting communications

You can ask us at any time to stop sending you information, through the channels in section 6.

8. Cookies and measurement tools

This site has no forms and does not store your data in its own database. It uses third-party tools that may set cookies:

• Google Ads and Google measurement tools: record visits and clicks on the WhatsApp and phone buttons to measure advertising. We do not send Google the content of your messages or your health results.
• Google Maps: the clinic location map.
• YouTube thumbnails: the images of the doctor's videos.

The knee test and the IKDC calculator compute your result in your own browser and do not store it. If you choose to send us your result by WhatsApp, we receive it like any other message. You can block or delete cookies in your browser settings.

9. Changes

Any change to this notice will be published on this page with the date of the last update.

10. Authority

If you believe your right to data protection has been violated, you may contact the competent Mexican authority, the Secretaría Anticorrupción y Buen Gobierno.
